PREAMBLE
The company Orchesia (hereinafter "Orchesia" or the "Publisher") publishes and operates a web application available at https://app.orchesia.com/app as well as a showcase website available at https://www.orchesia.com.
Orchesia is a visual, collaborative project management software tool intended for businesses, freelancers, students, or any other person wishing to structure and manage projects.
The Orchesia service is based on an innovative project management approach combining:
- a "Mind Map" interface based on the WBS (Work Breakdown Structure) method, enabling projects to be organized in a clear, hierarchical way;
- a "Dependencies" interface inspired by network diagrams, making it easier to understand and manage task relationships.
By combining these two methods, Orchesia automatically generates the main project steering tools expected by any manager: Gantt chart, calendar, lists, Kanban, and summary dashboard.
Orchesia distinguishes two project types:
- the structured project, whose end date is not known in advance and is inferred from its content (WBS breakdown, dependencies/PERT, critical path), which enables automatic generation of the Gantt chart; this falls under paid plans;
- the simplified project, whose end date is already fixed and which is organized into phases and milestones, with Kanban prioritization; this is the core of the free plan.
This distinction determines free or paid access to the features described below.
Access to the service requires creating a user account. Upon registration, the user benefits from a thirty (30) day free trial with access to all features. At the end of this period, and with no automatic charge, the user may either subscribe to a paid plan or continue to use the service free of charge under the free plan (one simplified project), without a bank card.
Users may collaborate with one another in shared workspaces. The showcase website www.orchesia.com and the articles published there are freely accessible without account creation.
Use of the Orchesia service implies full and unreserved acceptance of these Terms of Service.
SECTION 1 — IDENTITY OF THE WEBSITE CONTROLLER
Article 1.1 — Service publisher

Article 1.2 — Service hosting
The application and website are hosted on secure servers by third-party providers:
- Vercel (front-end hosting);
- Render (back-end hosting);
- MongoDB Atlas (database);
- AWS S3 (file and media storage).
These providers ensure data availability, security, and backup in accordance with industry best practices.
Article 1.3 — Contact

SECTION 2 — PURPOSE AND SCOPE OF THE WEBSITE
Article 2.1 — Purpose of the Terms
The purpose of these Terms of Service is to define the conditions under which:
- users access and use the website www.orchesia.com;
- users access, create an account, and use the web application https://app.orchesia.com/app;
- Orchesia provides its visual and collaborative project management services.
They govern the contractual relationship between Orchesia and any natural or legal person (hereinafter the "User") using the service, whether acting in a professional capacity or not.
Article 2.2 — Scope
These Terms of Service apply to:
- any browsing of the showcase website www.orchesia.com;
- any use of the Orchesia application available at URL app.orchesia.com/app;
- any creation, management, or participation in a workspace within the software.
Access to the service is open to any user, subject to:
- creating a user account;
- express acceptance of these Terms of Service;
- compliance with applicable laws and regulations.
Service access exists in two forms: a free plan (freemium) and paid plans, whose pricing conditions are set out in the Terms of Sale.
Use of the service implies unreserved acceptance of these Terms of Service in their current version, which prevail over any prior or conflicting document.
Article 2.3 — Applicable version and changes
Orchesia reserves the right to amend these Terms of Service at any time to adapt them to service changes, legislation, or operating conditions. Any amendment takes effect upon publication on the website.
Users are invited to consult the latest version regularly at: https://www.orchesia.com/en/terms-of-service.
SECTION 3 — USER ACCOUNT AND ACCESS TO THE SERVICE
Article 3.1 — Creating a user account
To access the main features of the Orchesia application, the user must create a personal account on the website https://app.orchesia.com/app.
The following information is required when creating an account:
- Last name,
- First name,
- Email address,
- Phone number,
- Password (encrypted).
The user may also choose to register and sign in via a Google account. Account creation implies full acceptance of these Terms of Service.
Article 3.2 — User account management
The user has a personal area from which they can:
- view and edit their information (last name, first name, password);
- manage the workspaces to which they have access.
The email address used at account creation constitutes the main identifier. The user undertakes to provide accurate, up-to-date information and not to impersonate a third party.
Each user account is personal, unique, and non-transferable. One user may only hold one main account, but may collaborate in several workspaces depending on the rights assigned to them.
Article 3.3 — Trial period
When creating an account, the user benefits from a thirty (30) day free trial, granting access to all service features, including paid-plan features. No bank card is required to start the trial.
At the end of this period, and without any automatic charge, the user may choose between:
- subscribing to a paid plan, allowing creation of multiple projects, structured projects, and advanced features; pricing conditions are detailed in the Terms of Sale;
- or continuing for free under the free plan described in Article 3.7, with no time limit.
Subscribing to a paid plan always results from a voluntary action by the user: no charge is applied automatically at the end of the trial.
Article 3.4 — Access under the free plan and seats
The home page available at URL https://app.orchesia.com/app as well as the account management interface remain available to any user holding an Orchesia account.
Under the free plan, the user has one free administrator seat giving access to their free workspace and simplified project, within the limits set out in Article 3.7. A seat can therefore be free or paid; it is considered "active" when it grants access to a workspace.
Each seat grants access to one or more workspaces according to rights assigned by the workspace owner. When the user is the sole member of a workspace, they must hold an administrator seat (free or paid depending on the plan) to access it.
The following remain reserved for paid plans: creation of additional projects (beyond the project included in the free plan) and structured projects (WBS/PERT mode, Gantt chart generation, AI-assisted generation). By contrast, workspace-wide tools (cycles, workload and capacity tracking, dashboards) remain available under the free plan; their usefulness is simply limited while the workspace contains only one project.
Article 3.5 — Account suspension and termination
Orchesia reserves the right to suspend or terminate a user account without notice in the event of:
- fraud, abuse, or unauthorized use of the service;
- breach of these Terms of Service;
- attempted illegal access or breach of system security;
- conduct causing harm to Orchesia or another user.
In case of suspension, account access is temporarily blocked. In case of termination, the account and associated data are permanently deleted, with no right to compensation.
Article 3.6 — User responsibility
The user is fully responsible for:
- actions performed from their account;
- the confidentiality of their login credentials;
- content they import, create, or share on Orchesia.
The user undertakes to immediately notify Orchesia in the event of unauthorized access or compromise of their credentials.
Orchesia cannot be held liable for fraudulent use of an account resulting from user negligence.
Article 3.7 — Free plan (Freemium)
At the end of the trial period, a user who does not subscribe to a paid plan benefits from free access with no time limit to Orchesia's free plan.
The free plan includes:
- one (1) free workspace (a user cannot hold several free workspaces);
- within that workspace, one (1) simplified project;
- up to fifteen (15) phases and one hundred fifty (150) items;
- one (1) free administrator seat;
- simplified mode features (phases, milestones, Kanban prioritization, items).
It requires no payment or bank card.
Workspace-wide tools (cycles, workload and capacity tracking, dashboards) remain available under the free plan; however, their usefulness is limited where the workspace contains only one project.
The following are covered by paid plans: creation of additional projects, structured projects (WBS, dependencies/PERT, Gantt chart generation, AI-assisted generation), and multi-seat collaboration. Conditions for these plans are detailed in the Terms of Sale.
From trial to free plan
At the end of the trial:
- if the user subscribes to a paid plan, they retain access to their workspace under the same conditions as during the trial;
- if they do not subscribe, they access their workspace and, depending on how many simplified projects they hold at that time:
- one (1) simplified project: this project remains accessible; the user becomes the only member who can access it. Other members, if any, can still view this workspace that has moved to the free plan, but can no longer access it; a message invites them to contact the workspace administrator for more information (the free plan includes only one seat);
- no simplified project: the user may create one (1);
- multiple simplified projects: a dedicated window prompts them to choose the simplified project they wish to keep under the free plan.
Fate of other projects. Structured projects and simplified projects not retained (when there are several) are archived: they are kept but remain inaccessible until a paid plan is subscribed to. Later subscription to a paid plan restores access to these archived projects. No deletion occurs solely for this reason; data retention periods and terms remain otherwise governed by the Terms of Sale and the Privacy Policy.
SECTION 4 — RULES OF USE AND PROHIBITED CONDUCT
Article 4.1 — Proper use and shared content
Users undertake to use Orchesia in compliance with the law, best practices, and these Terms of Service. The application must be used for legitimate personal or professional purposes and may under no circumstances be used for illegal, fraudulent, harmful, or public-order violating purposes.
Users remain solely responsible for the data, files, projects, and information they create, store, or share through Orchesia.
Orchesia does not carry out prior control over such content, but reserves the right to remove without notice any content that is clearly unlawful or contrary to these terms as soon as it becomes aware of it.
Each user is responsible for maintaining external backups of important data.
Orchesia cannot be held liable for any loss, alteration, or deletion of data resulting from misuse of the service or user failure to comply with obligations.
Article 4.2 — Service security and integrity
In order to ensure platform stability and security, it is strictly prohibited to:
- attempt to access source code, decompile, disassemble, or perform reverse engineering on all or part of the software;
- use scripts, robots, software, or any other automated means to interact with Orchesia, collect, or extract data (scraping, automation, etc.);
- circumvent implemented security measures or exploit a technical flaw;
- deliberately disrupt operation of the service or harm other users' experience.
Any attempted intrusion or security breach may lead to civil and/or criminal proceedings.
Article 4.3 — Fair use and respect for the service
The user undertakes to adopt fair and respectful behavior toward the service and other users. In this respect, it is prohibited in particular to:
- use Orchesia to develop, test, promote, or distribute a competing service, directly or indirectly;
- resell, transfer, or share their account with third parties without Orchesia's written authorization;
- reproduce, imitate, or misappropriate the concept, design, code, or any other component of the software without written authorization.
The usage rights granted to each user are strictly personal, non-exclusive, and non-transferable.
Article 4.4 — Penalties in case of breach
In case of non-compliance with these terms, Orchesia may, at its sole discretion:
- issue a warning to the user concerned;
- temporarily suspend access to their account;
- or permanently delete the user account, without notice, in case of serious breach.
In the most serious cases — such as fraud, breach of service security, dissemination of unlawful content, or manifest breach of law — Orchesia reserves the right to seek civil and/or criminal liability of the user concerned.
Article 4.5 — Limitation of liability
Orchesia cannot be held liable for:
- user behavior;
- content published, shared, or transferred via the platform;
- or any damage resulting from non-compliant use of the service.
The user unreservedly acknowledges that they are fully responsible for their use of the service and the information they place on it.
SECTION 5 — PERSONAL DATA AND CONFIDENTIALITY
Article 5.1 — Collected data
As part of use of the Orchesia service, certain personal data is collected and processed by Orchesia. Such data includes in particular:
- the user's last and first name;
- their email address;
- their phone number;
- their password (encrypted and inaccessible to the team);
- usage data related to use of the service (project names, tasks, durations, dependencies, etc.);
- and, where applicable, files uploaded by users (documents, images, videos, attachments).
This information is required to:
- create and manage the user account;
- ensure proper operation of the service;
- manage payments;
- enable technical support intervention.
Data is accessible only to Orchesia's administrator and data manager, strictly for the purposes mentioned above.
Article 5.2 — Hosting and security
Data is hosted on secure servers distributed among several technical providers:
- Vercel for the front-end;
- Render for the API and back-end;
- MongoDB Atlas for the database;
- AWS S3 for file storage.
All communications between the user and the service are protected by the HTTPS protocol. Passwords are encrypted and cannot under any circumstances be read in plain text.
Orchesia applies current security standards to guarantee the confidentiality, integrity, and protection of personal data against unauthorized access, loss, or alteration.
Article 5.3 — Retention and deletion
Personal data is retained as long as the user account is active. When a user deletes their account, all associated data and files are permanently removed from Orchesia systems.
Users may delete their account and data at any time by sending a request to: contact@orchesia.com.
Article 5.4 — User rights
In accordance with the General Data Protection Regulation (GDPR), each user has the following rights:
- right of access to their data;
- right to rectification;
- right to erasure (right to be forgotten);
- right to data portability;
- right to restriction of processing;
- right to object to processing of their data.
To exercise these rights, users may submit a written request to: contact@orchesia.com. Orchesia undertakes to respond within the statutory GDPR deadlines.
Article 5.5 — Privacy Policy
Detailed processing of personal data, implemented security measures, and technical processors used by Orchesia are described in the Privacy Policy, accessible at any time from the website or application. This policy supplements these Terms of Service and forms an integral part of them.
SECTION 6 — INTELLECTUAL PROPERTY
Article 6.1 — Ownership of rights
All elements constituting the Orchesia application, associated website, and their content — including source code, software architecture, design, texts, graphics, visuals, logo, and the "Orchesia" trademark — are the exclusive property of Orchesia.
The name "Orchesia" is a trademark registered with INPI and protected under French and international law. Any reproduction, distribution, modification, representation, adaptation, translation, or dissemination, in whole or in part, of any of these elements without prior written authorization from Orchesia is strictly prohibited and constitutes infringement likely to trigger civil and/or criminal liability.
Article 6.2 — User content
Users retain full ownership of data and content they create, import, or store through Orchesia (projects, tasks, documents, files, etc.).
By using the service, the user grants Orchesia a limited, non-exclusive license strictly necessary to host, store, back up, and process such data, solely for operation, maintenance, and security of the service.
Orchesia claims no ownership rights over user content and does not use it for commercial purposes under any circumstances.
Article 6.3 — Third-party and open-source elements
Certain technical components, software libraries, or graphic resources used in Orchesia may come from open-source or royalty-free sources, used in accordance with their respective licenses. These elements remain the exclusive property of their original authors or publishers. Orchesia undertakes to comply with license terms associated with these third-party components.
Article 6.4 — Use of name and logo
Use of Orchesia's name, logo, or any other distinctive sign for commercial, advertising, or promotional purposes is authorized only with Orchesia's prior written consent. Any unauthorized use, direct or indirect, is strictly prohibited and may result in legal proceedings.
SECTION 7 — LIABILITY AND WARRANTIES
Article 7.1 — Nature of the service
Orchesia is SaaS software provided "as is." Orchesia uses all reasonable means to ensure continuous availability of the service and limit errors, without however being able to guarantee absolute accessibility or reliability.
Access to the service may be temporarily interrupted, in particular for maintenance, updates, technical upgrades, or in case of incidents beyond Orchesia's control. In case of prolonged unavailability, Orchesia may, at its sole discretion, offer a commercial gesture or extension of active-seat duration, without this constituting an obligation to compensate.
Article 7.2 — Limitation of liability
Orchesia's liability cannot be engaged in case of:
- loss, alteration, or deletion of data;
- technical failure, bug, or service interruption;
- calculation, display, or synchronization error;
- use of the service not compliant with these terms.
In all circumstances, Orchesia's liability, regardless of its nature or legal basis, is strictly limited to the total amount effectively paid by the user during the last twelve (12) months preceding the event causing damage. This limitation is an essential clause of the contract binding Orchesia and the user.
Article 7.3 — User obligations
The user undertakes to:
- have the equipment, browser, and Internet connection required for proper operation of the service;
- back up locally any information or files they consider essential;
- not use the service in a manner likely to damage, disrupt, or compromise Orchesia's security or integrity.
Any non-compliant or improper use of the service engages the user's sole liability.
Article 7.4 — No guarantee of results
Orchesia provides a tool to assist with project management and planning.
The user expressly acknowledges that Orchesia provides no guarantee of results regarding success, performance, or compliance of projects managed through the platform.
The application is an assistance and visualization tool whose effectiveness depends entirely on the quality of entered data and how the user uses the service.
Article 7.5 — Force majeure
Orchesia cannot be held liable for non-performance resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code, notably in case of widespread hosting outage, major cyber attack, pandemic, war, or natural disaster.
SECTION 8 — APPLICABLE LAW AND DISPUTE RESOLUTION
Article 8.1 — Applicable law
These Terms of Service are governed by French law, regardless of the user's country of origin or place of service use. By accessing Orchesia, the user acknowledges that only French law applies to their contractual relationship with Orchesia, including where the service is used from abroad.
Article 8.2 — Amicable resolution
In case of dispute relating to interpretation, performance, or validity of these terms, the parties undertake to seek an amicable solution before any legal action. The user may submit their complaint or request for information to: contact@orchesia.com. Orchesia will endeavor to respond as promptly as possible to encourage rapid and fair dispute resolution.
If no amicable agreement is reached within a reasonable time, the dispute may be brought before competent courts pursuant to the provisions below.
Article 8.3 — Competent court
For any dispute relating to validity, interpretation, or performance of these Terms of Service, courts within the jurisdiction of Orchesia's registered office shall have exclusive jurisdiction, including in the event of multiple defendants, third-party proceedings, or emergency proceedings. This jurisdiction clause is expressly accepted by professional users.
In accordance with Article R. 631-3 of the French Consumer Code, consumers may bring proceedings, at their choice:
- before the court of the place where they resided at the time of contract conclusion, or
- before the court of the place where the harmful event occurred.
Any clause to the contrary shall be deemed unwritten.
Article 8.4 — Territorial scope
The Orchesia service is accessible in France and internationally. Foreign users acknowledge that service operation, documentation, and support are governed by rules and standards applicable in France, and accept that any dispute is subject to French jurisdiction as specified in the previous article.
SECTION 9 — ENTRY INTO FORCE AND AMENDMENT OF TERMS
Article 9.1 — Entry into force
These Terms of Service enter into force as from their publication date on the Orchesia website or application. They remain applicable throughout the user's use of the service.
Article 9.2 — Amendment of terms
Orchesia reserves the right to amend or update these Terms of Service at any time, in particular to adapt them to:
- legal or regulatory developments;
- technical or functional changes to the service;
- adjustments linked to its internal policy.
Any substantial amendment will be notified to users by appropriate means (in-app notification, email, or website notice). Continued use of the service after such notice constitutes full acceptance of the new terms.
Article 9.3 — Applicable version
In case of interpretative divergence between several versions of these Terms of Service, the most recent version published on the Orchesia website prevails. Users are invited to consult the Terms of Service regularly to stay informed of any updates.
Article 9.4 — Severability
If one or more provisions of these Terms of Service are declared null, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
