Orchesia (hereinafter “Orchesia” or the “Publisher”) operates a web application available at https://app.orchesia.com/app as well as a marketing website available at https://www.orchesia.com.
Orchesia is a visual and collaborative project management software designed for businesses, freelancers, students and any person wishing to structure and manage their projects.
The Orchesia service relies on an innovative project management approach combining:
By combining these two methods, Orchesia automatically generates the main project management tools expected by any project manager: Gantt chart, calendar, lists, Kanban and summary dashboard.
Access to the service requires the creation of a user account. When signing up, the user benefits from a free trial period of two (2) weeks, after which full access to their workspaces requires the purchase of an active seat.
Users can collaborate together within shared workspaces. The website www.orchesia.com and the articles published on it are freely accessible without creating an account.
Use of the Orchesia service implies full and unconditional acceptance of these Terms of Use.

To access the main features of the Orchesia application, the user must create a personal account on https://app.orchesia.com/app.
When creating an account, the following information is required:
The user may also choose to sign up and log in via a Google account. Creating an account implies full and unconditional acceptance of these Terms of Use.
The user has access to a personal area from which they may:
The email address used when creating the account is the primary identifier. The user undertakes to provide accurate, up-to-date information and not to impersonate any third party.
Each user account is personal, unique and non-transferable. A single user may only have one main account but may collaborate in multiple workspaces depending on the rights granted to them.
When creating an account, the user benefits from a free trial period of two (2) weeks. During this period, they may create and manage as many workspaces as they wish.
At the end of this period, the workspaces become inaccessible. Access to a workspace is restored as soon as the user has at least one active (paid) seat associated with their account, allowing them to collaborate within that workspace.
Each seat grants access to one or more workspaces depending on the rights granted by the workspace owner. When the user is the sole member of a workspace, they must hold an administrator seat in order to regain access.
The home page https://app.orchesia.com/app and the account management interface remain accessible to any user with an Orchesia account. However, the user will only have access to workspaces for which they hold an active seat.
Features associated with inactive workspaces remain locked and inaccessible.
Orchesia reserves the right to suspend or terminate a user account without prior notice in the event of:
In the event of suspension, access to the account is temporarily blocked. In the event of termination, the account and related data are permanently deleted, with no right to compensation.
The user is fully responsible for:
The user undertakes to inform Orchesia immediately in case of unauthorised access or compromise of their credentials. Orchesia cannot be held liable for fraudulent use of the account resulting from the user’s negligence.
Users undertake to use Orchesia in compliance with the law, good practice and these Terms of Use. The application must be used only for legitimate personal or professional purposes and may in no case be used for illegal, fraudulent, harmful or unlawful purposes or contrary to public order.
Users remain solely responsible for the data, files, projects and information they create, store or share via Orchesia. Orchesia does not exercise prior control over such content but reserves the right to remove, without prior notice, any content that is manifestly unlawful or contrary to these Terms once it becomes aware of it.
It is each user’s responsibility to maintain an external backup of important data. Orchesia cannot be held liable for any loss, alteration or deletion of data resulting from misuse of the service or from the user’s failure to meet their obligations.
To ensure the stability and security of the platform, it is strictly forbidden to:

In the event of a breach of these Terms, Orchesia may, at its sole discretion:
In the most serious cases — such as fraud, security breaches, sharing of unlawful content or clear violation of the law — Orchesia reserves the right to seek the civil and/or criminal liability of the user concerned.

All communications between the user and the service are protected by the HTTPS protocol. Passwords are encrypted and can never be read in plain text.
Orchesia applies current security standards to ensure the confidentiality, integrity and protection of personal data against any unauthorised access, loss or alteration.
Personal data is retained for as long as the user account is active. When a user deletes their account, all of their related data and files are permanently deleted from Orchesia’s systems.

In accordance with the General Data Protection Regulation (GDPR), every user has the following rights:

Detailed information on personal data processing, security measures and the technical processors used by Orchesia are provided in the Privacy Policy, which is accessible at any time from the site or application. This policy supplements these Terms of Use and forms an integral part of them.
All elements making up the Orchesia application, the associated website and their contents — including but not limited to the source code, software structure, design, texts, graphics, visuals, logo and the “Orchesia” brand — are the exclusive property of Orchesia.
The name “Orchesia” is a registered trademark with the French National Institute of Industrial Property (INPI) and is protected under French and international law. Any reproduction, distribution, modification, representation, adaptation, translation or dissemination, in whole or in part, of any of these elements without Orchesia’s prior written consent is strictly prohibited and may constitute infringement resulting in civil and/or criminal liability.
Users retain full ownership of the data and content they create, import or store via Orchesia (projects, tasks, documents, files, etc.).
By using the service, the user grants Orchesia a limited, non-exclusive licence strictly necessary to host, store, back up and process such data solely for the purposes of operating, maintaining and securing the service.
Orchesia does not claim any ownership rights over user content and does not use it for commercial purposes.
Certain technical components, software libraries or graphic resources used in Orchesia may come from open-source or royalty-free sources and are used in accordance with their respective licences. These elements remain the exclusive property of their original authors or publishers. Orchesia undertakes to comply with the licence terms applicable to these third-party components.
Use of the Orchesia name, logo or any other distinctive sign for commercial, advertising or promotional purposes is only permitted with Orchesia’s prior written consent. Any unauthorised use, whether direct or indirect, is strictly prohibited and may give rise to legal action.
Orchesia is SaaS software provided “as is”. Orchesia uses all reasonable means to ensure continuous availability of the service and to limit errors, but cannot guarantee uninterrupted access or absolute reliability.
Access to the service may be temporarily interrupted, in particular for maintenance, updates, technical developments or incidents beyond Orchesia’s control. In the event of prolonged unavailability, Orchesia may, at its sole discretion, offer a commercial gesture or an extension of active seat duration, without this constituting an automatic obligation to provide compensation.
Orchesia cannot be held liable for:
In any event, Orchesia’s total liability, whatever the cause or legal basis, is strictly limited to the total amount actually paid by the user in the twelve (12) months preceding the event giving rise to the damage. This limitation is an essential condition of the contract between Orchesia and the user.

Any improper or diverted use of the service is the sole responsibility of the user.
Orchesia provides a tool to assist with project planning and management. The user expressly acknowledges that Orchesia does not provide any guarantee of results, in particular regarding the success, performance or compliance of any project managed through the platform.
The application is a support and visualisation tool whose effectiveness depends entirely on the quality of the data entered and on how the user uses the service.
Orchesia cannot be held liable in the event of failure to perform due to an event of force majeure within the meaning of Article 1218 of the French Civil Code, including but not limited to general hosting outages, major cyberattacks, pandemics, war or natural disasters.
These Terms of Use are governed by French law, regardless of the user’s country of origin or the location from which the service is used. By accessing Orchesia, the user acknowledges that only French law governs their contractual relationship with Orchesia, even in the event of use of the service from abroad.
In the event of a dispute relating to the interpretation, performance or validity of these Terms, the parties undertake to seek an amicable solution before initiating legal proceedings. The user may address their complaint or request for information to: contact@orchesia.com. Orchesia will endeavour to respond as soon as possible to facilitate quick and fair resolution of the dispute.
If no amicable solution is found within a reasonable period, the dispute may be brought before the competent courts as set out below.
Any dispute relating to the validity, interpretation or performance of these Terms of Use shall be submitted to the exclusive jurisdiction of the courts having jurisdiction over Orchesia’s registered office, including in the event of multiple defendants, third-party proceedings or emergency proceedings. This jurisdiction clause is expressly accepted by the user.
The Orchesia service is accessible in France and internationally. Foreign users acknowledge that the operation of the service, its documentation and support are governed by the rules and standards applicable in France and agree that any dispute shall be submitted to the French courts as specified in the preceding article.
These Terms of Use enter into force on the date of their publication on the Orchesia site or application and remain applicable for the entire duration of use of the service by the user.
Orchesia reserves the right to modify or update these Terms at any time, in particular to adapt them to:
Any material change will be notified to users by an appropriate means (in-app notification, email or notice on the site). Continued use of the service after such notification constitutes full and unconditional acceptance of the new Terms.
In the event of discrepancies between several versions of these Terms, the most recent version published on the Orchesia site shall prevail. Users are invited to regularly consult the Terms in order to keep informed of any updates.
If one or more provisions of these Terms are held to be null, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
